Terms

Last updated 12 October 2026

These terms apply to every website we build and run for you. We keep them short and in plain language. If anything here is unclear, write to office@spectrumit.eu before you order.

1. Who we are and who this is for

The services are provided by Spectrum IT Solutions GmbH, Kurbadstraße 8/1604, 1100 Vienna, Austria, FN 393588 g, VAT ID ATU67898466 (“we”). Full company details are in the Imprint.

We work only with businesses. By ordering, you confirm that you order for your business and not as a consumer. Your own terms and conditions do not apply, unless we have agreed to them in writing.

2. How an order works

First we agree what your website will include, by call or by email. We then send you an offer that describes it: the pages, the language and any extra work. That description is the “scope”.

The contract starts when you accept the offer in writing (an email is enough) and activate your yearly subscription. We start work once the first yearly payment has gone through.

3. What the website includes

  • A design made for your business, the wording drafted by us and checked by you, and your photos cropped, corrected and optimised.
  • Up to 5 pages in one language: English, German, Romanian, Serbian or Thai. A page is anything with its own place in the menu, such as Home, About, Menu, Gallery or Contact. A page counts once, however many sections it has. Legal pages, such as a privacy policy or an imprint, do not count towards the 5.
  • A contact form, the basic setup for search engines, and legal pages for your country, such as a privacy policy.

We draft the legal pages from the information you give us. They are not legal advice. You are responsible for your website meeting the legal requirements wherever you do business, such as privacy and disclosure rules, and for checking that the details in these pages are correct and complete. Whenever they need to change, we update them at no extra cost (see section 4).

Before launch, we change the website based on your feedback for as long as the changes stay within the agreed scope. Anything beyond the scope is quoted first.

4. What the yearly price includes

  • Hosting, security updates, certificates and renewals, and a kept history of every previous version.
  • Delivery of contact form messages to your inbox.
  • Up to 12 small changes per subscription year, requested by email or through our form.
  • Updates to your legal pages whenever you ask for them, for example after a change in the law or in your business. These do not count towards the 12 small changes.

A small change is a change to something that is already on your website: wording, photos, prices, menus, opening hours, colours, fonts, the order of sections, or one more item in something that exists, like a dish or a team member. One request counts as one change, even if it touches every page. Examples are on our changes page.

Anything new is not a small change and is quoted before we start. That includes a new page, a new section, new features such as bookings, a shop or a newsletter sign-up, a second language, and a redesign. If a request turns out bigger than it sounds, we tell you before we start.

We aim to complete small changes within two working days of receiving everything we need. Changes that are not used in a subscription year do not carry over to the next one.

The yearly price covers the traffic of a normal business website. Video hosting, large file downloads, or traffic far beyond a typical business website are quoted separately.

5. Your domain and email

Your domain is registered in your name and paid by you. You give us the access we need to connect it, and we take care of the setup. Email mailboxes are not part of our service.

6. Your part

You provide the material and information we need and give feedback in reasonable time. The subscription year runs from the first payment, also if the launch is delayed because material or feedback is missing.

You confirm that you have the rights to everything you send us, such as photos, logos and texts, and that publishing it does not break the law or anyone else’s rights. If a third party makes a claim against us because of material you provided, you cover our costs.

7. Price and payment

The price is the one in your offer, by default €500 per year. All prices exclude VAT, which is added where the law requires it. For businesses in other EU countries with a valid VAT ID, the reverse charge applies. Businesses outside the EU are not charged Austrian VAT.

The yearly price is paid in advance by automatic card payment, at the start and at each renewal. Payments are processed by Stripe. Invoices are created automatically, so there is nothing to pay by bank transfer.

You get your own billing page, run by Stripe. There you can update your card and billing details, add your VAT ID, download every invoice and cancel your subscription.

If a payment fails, we retry and let you know by email. If it is still not paid 14 days after the due date, we may take the website offline until it is paid.

A payment that is reversed through a chargeback counts as not paid, and the rules for unpaid payments apply. If you think a charge is wrong, please write to us first. If we made a mistake, we refund it. If a chargeback turns out to be unfounded, you also pay the dispute fee our payment provider charges us, as well as the default interest and the €40 recovery fee the law provides for late payment between businesses.

We may change the yearly price for future subscription years. We tell you at least 60 days before your next renewal, so you can decide whether to continue.

8. Term, renewal and cancellation

Each subscription year runs for 12 months from the payment date and renews automatically for another year. We send you a reminder 30 days before each renewal.

You can cancel at any time before the renewal date, yourself on your billing page or by email to office@spectrumit.eu. The cancellation takes effect at the end of the current subscription year. A year that has started is not refunded, and you keep the full year of service.

We may end the contract at the end of a subscription year by telling you at least 60 days before. We may end it straight away if a payment remains unpaid or the website is used for anything illegal.

9. When you leave

When your last paid year ends, we give you the complete website files and help you point your domain to whoever looks after it next. Hosting, contact form delivery and changes stop at that point. The handover happens once everything owed has been paid.

Your words, photos and logo always remain yours. Once paid, you may use the website we built for you for your own business, without time limit, including with another provider. We keep the right to use the ideas, designs, code, tools and know-how from our work for other clients as well.

10. Availability

Your website runs on Cloudflare’s global network and is usually available around the clock. We cannot guarantee uninterrupted availability, for example during outages of our providers or of the internet in general.

If your website goes down because of a fault on our side, we start fixing it as soon as we notice or you tell us, and restore it within 48 hours at the latest. Outages at our providers, such as Cloudflare, and problems with your domain at your registrar are outside our control. In those cases we restore your website as soon as possible, and the 48 hours do not apply.

11. Liability

We are liable for damage we cause intentionally or through gross negligence. We are not liable for slight negligence, except for injury to people. We are not liable for lost profit, indirect damage or damage caused by services of third parties. Our total liability per subscription year is limited to the amount you paid us for that year.

12. Personal data

Where we handle personal data on your behalf, for example contact form messages from your visitors, we do so as your processor under Art. 28 GDPR, on the terms of our data processing agreement. How we handle data on our own website is described in our privacy policy.

13. References

We may show your website as a reference, with your name, logo and screenshots. If you would rather we did not, tell us and we stop.

14. Changes to these terms

We may update these terms for future subscription years. We tell you about changes at least 60 days before your next renewal. If you do not agree, you can cancel before that renewal.

15. Law and court

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The court with subject-matter jurisdiction in Vienna has exclusive jurisdiction. If a clause in these terms is invalid, the rest remain in force.
